Representing PNSB Acmar in High Court land acquisition judicial review of RM 290 million claims

KUALA LUMPUR – Goik Ramesh & Loo is representing PNSB Acmar Sdn Bhd in its RM 290 million land acquisition matter against Selangor State Authority due for judicial review in the Kuala Lumpur High Court.

PNSB Acmar is the proprietor for a piece of land in Mukim Kapar, Daerah Klang, Selangor, where part of the land was acquired by the Selangor State Authority for the Federal Government pursuant to Section 3(1)(a) of the Land Acquisition Act 1960 for public purposes. namely to construct “Projek Transit Aliran Ringan Laluan 23 (LRT 3) Bandar Utama ke Johan Setia, Jajaran Daerah Klang, Selangor”.

The Selangor State Authority having held the enquiry awarded PNSB Acmar compensation in the sum of RM 267 million and RM 23.5 million to Malaysia Building Society Berhad, the charge holder, through the issuance of Form H pursuant to Section 16 of the Land Acquisition Act 1960.

The Selangor State Authority subsequently issued a notice of withdrawal and on 11 October 2018 published a gazette notification (No. 3920) that withdrew the said acquisition pursuant to Section 35 of the Act.

"We are honoured to represent and work with our clients in this significant land acquisition matter. We believe that the decision in withdrawing from the acquisition pursuant to Section 35 of the Act is illegal, irrational and/or unreasonable and an abuse of process. Therefore, no withdrawal from the acquisition can be made as the State Authority had taken possession of the scheduled land”, said Goik Kenzu.
